Rules and legal terms for using BiMakas services.

1. Parties

This agreement is entered into between Muhammet Sinan Baysan ("Company") and the person using the BiMakas mobile app/web platform ("User").

2. Subject of the Agreement

This agreement defines the terms of use of the BiMakas platform and the rights/obligations of the parties. By using the app, the User accepts these terms.

3. Service Definition

BiMakas is a digital platform that enables users to create appointments for barber and beauty services, make payments, and communicate with service providers.

Services are provided:

  • By professionals within the platform team, or
  • By independent service providers registered on the platform.

4. Membership and Account Security

The User is responsible for:

  • Providing accurate and up-to-date information during registration,
  • Protecting the confidentiality of account credentials,
  • Being responsible for actions performed through their account.

The Company may temporarily or permanently restrict an account in suspected security situations.

5. Rules of Use

The User may not use the platform:

  • For unlawful purposes,
  • In a way that harms others,
  • For unfair commercial gain or manipulative purposes,
  • Through attempts that compromise system security.

6. Appointment, Payment, Cancellation, and Refund

  • Appointment conditions may vary by selected service and provider.
  • Payment is made through approved methods within the app.
  • Cancellation/refund conditions may vary based on time remaining until the appointment.
  • Approved refunds may be reflected within 3-10 business days depending on the bank.

7. Intellectual Property

All intellectual property rights related to app software, design, brand, logo, and content belong to the Company. They may not be copied, distributed, or used commercially without written permission.

8. Limitation of Liability

The Company does not guarantee uninterrupted or error-free operation of the app. Liability for indirect damages arising from technical failures, third-party service outages, and similar events is limited to the extent permitted by law.

9. Account Suspension and Termination

If the User violates this agreement, the Company may:

  • Temporarily suspend access,
  • Permanently terminate membership/service.

The User may also request account closure at any time.

10. Right to Amend

The Company may update this agreement in line with legal or operational needs. The updated text enters into force on the date it is published.

11. Governing Law and Jurisdiction

Disputes arising from this agreement are subject to the jurisdiction of Istanbul Courts and Enforcement Offices.

1. Taraflar

Isbu sozlesme, bir tarafta Muhammet Sinan Baysan ("Sirket") ile diger tarafta BiMakas mobil uygulamasi/web platformunu kullanan kisi ("Kullanici") arasinda akdedilmistir.

2. Sozlesmenin Konusu

Bu sozlesme, BiMakas platformunun kullanim kosullarini ve taraflarin hak/yukumluluklerini belirler. Kullanici, uygulamayi kullanarak bu sartlari kabul eder.

3. Hizmet Tanimi

BiMakas; kullanicilarin kuafor ve guzellik hizmetleri icin randevu olusturmasini, odeme yapmasini ve hizmet saglayicilarla iletisime gecmesini saglayan dijital platformdur.

Hizmetler:

  • Platform bunyesindeki uzmanlarca, veya
  • Platforma kayitli bagimsiz hizmet saglayicilar tarafindan sunulur.

4. Uyelik ve Hesap Guvenligi

Kullanici:

  • Kayit sirasinda dogru ve guncel bilgi vermekle,
  • Hesap bilgilerinin gizliligini korumakla,
  • Hesabi uzerinden yapilan islemlerden sorumlu olmakla yukumludur.

Sirket, supheli guvenlik durumlarinda hesabi gecici veya kalici olarak kisitlayabilir.

5. Kullanim Kurallari

Kullanici, platformu:

  • Hukuka aykiri amaclarla,
  • Baska kisilere zarar verecek sekilde,
  • Haksiz ticari kazanc veya manipulatif amaclarla,
  • Sistem guvenligini zedeleyecek girisimlerle kullanamaz.

6. Randevu, Odeme, Iptal ve Iade

  • Randevu kosullari, secilen hizmet ve saglayiciya gore degisebilir.
  • Odeme, uygulama icindeki onayli yontemlerle yapilir.
  • Iptal/iade kosullari, randevu saatine kalan sureye gore degisiklik gosterebilir.
  • Onayli iadeler, bankaya bagli olarak 3-10 is gunu icinde yansiyabilir.

7. Fikri Mulkiyet

Uygulama yazilimi, tasarim, marka, logo ve iceriklere iliskin tum fikri mulkiyet haklari Sirket'e aittir. Yazili izin olmadan kopyalanamaz, dagitilamaz ve ticari amacla kullanilamaz.

8. Sorumlulugun Sinirlandirilmasi

Sirket, uygulamanin kesintisiz veya hatasiz calisacagini garanti etmez. Teknik aksakliklar, ucuncu taraf servis kesintileri ve benzeri durumlardan kaynakli dolayli zararlardan sorumluluk, mevzuatin izin verdigi olcude sinirlidir.

9. Hesap Askiya Alma ve Fesih

Kullanici bu sozlesmeyi ihlal ederse Sirket:

  • Erisimi gecici olarak durdurabilir,
  • Uyelik/hizmeti kalici olarak sonlandirabilir.

Kullanici da diledigi zaman hesabini kapatma talebinde bulunabilir.

10. Degisiklik Hakki

Sirket, mevzuat veya operasyonel ihtiyaclar dogrultusunda sozlesmeyi guncelleyebilir. Guncel metin yayinlandigi tarihte yururluge girer.

11. Uygulanacak Hukuk ve Yetki

Isbu sozlesmeden dogan uyusmazliklarda Istanbul Mahkemeleri ve Icra Daireleri yetkilidir.
